Terms of Agreement

1  Companion placement and no breeding rights. The kitten is sold solely as a companion. No breeding rights are granted or transferred. The Buyer must not intentionally or unintentionally breed the kitten, permit the kitten to mate, offer the kitten for stud or queen service, collect or preserve reproductive material, or register any litter produced by or from the kitten. Any registration supplied for the kitten will be designated non-breeding where that designation is available.

2  Mandatory spay or neuter. The Buyer must have the kitten spayed or neutered by a licensed veterinarian no later than the date the kitten reaches 12 months of age. The Buyer is responsible for all costs and risks associated with the procedure and aftercare.

3  Proof of sterilization. Within 14 days after the procedure, and in every case no later than 14 days after the kitten's first birthday, the Buyer must send the Seller a veterinary invoice, certificate, or signed veterinary letter that identifies the kitten and confirms the procedure date. The Seller may verify the document with the veterinary clinic.

4  Veterinary delay. If a licensed veterinarian advises in writing that sterilization by 12 months would create a material medical risk, the Buyer must provide that written advice to the Seller before the deadline. The parties will set the earliest medically appropriate replacement date in writing. A delay does not grant breeding rights, and the Buyer must prevent all access to intact cats during the delay.

5  Breach of reproductive restrictions. Failure to sterilize the kitten by the applicable deadline, failure to provide proof, or any breeding or mating is a material breach of this agreement. The Buyer must immediately notify the Seller and arrange sterilization as soon as medically appropriate. The Seller may seek return of the kitten, an order preventing further breeding, recovery of reasonable enforcement costs where permitted, and any other remedy available by law. No breach creates or implies breeding rights.

Health and Veterinary Care

6  Condition at transfer. The Buyer confirms that they have had an opportunity to observe the kitten and review the health and care information provided by the Seller. The following known conditions or disclosures, if any, form part of this agreement: ____________________________________________________________________________________________.

7  Post-transfer examination. The Buyer is encouraged to have the kitten examined by a licensed veterinarian within 72 hours of transfer, excluding Sundays and statutory holidays. If the veterinarian identifies a serious pre-existing health concern, the Buyer must notify the Seller promptly and provide the complete written veterinary findings before authorizing non-emergency euthanasia or major treatment. Emergency treatment must never be delayed to contact the Seller.

8  Ongoing care. The Buyer will provide appropriate nutrition, fresh water, safe housing, enrichment, companionship, routine and emergency veterinary care, parasite control appropriate to the kitten's circumstances, and humane treatment throughout the cat's life. The Buyer will maintain the kitten at a healthy body condition and follow reasonable veterinary advice tailored to the kitten.

9  Vaccination and records. The Buyer will discuss vaccination, titer testing where appropriate, and preventive care with a licensed veterinarian and make informed decisions based on the kitten's health and exposure risks. The Seller will provide the health records in the Seller's possession at transfer.

Lifetime Placement Responsibilities

10  Indoor safety. The Buyer will keep the cat indoors or provide secure, supervised outdoor access such as a catio, harness, or enclosed area. The cat must not be permitted to roam freely outdoors.

11  No declawing. The Buyer will not have the kitten declawed or undergo a tendonectomy unless a licensed veterinarian determines that the procedure is medically necessary for the kitten rather than for convenience.

12  Mandatory lifetime return to the Seller. If at any time and for any reason the Buyer is unable or no longer willing to keep the cat, including because of a change in housing, finances, relationships, family circumstances, health, employment, allergies, or lifestyle, the Buyer must notify the Seller and return the cat directly to the Seller. The Buyer must not advertise, sell, give away, rehome, lease, trade, abandon, surrender, or otherwise transfer the cat to any other person or organization, including family, friends, shelters, rescues, pet stores, brokers, or breeders. The Buyer must keep the cat safely until return arrangements are made and is responsible for reasonable return transportation unless the Seller agrees otherwise in writing.

13  Seller controls every future placement. After the cat is returned, the Seller has the sole right and responsibility to evaluate prospective homes, complete the interview and approval process, and select the cat's next home. The Buyer has no right to choose the new owner, transfer the cat directly to a proposed home, or require the Seller to place the cat with any particular person.

14  Absolutely no refunds. A return under this agreement is final. The Seller owes the Buyer no refund, reimbursement, credit, compensation, or share of any future adoption or placement fee, regardless of the cat's age, health, original purchase price, length of time in the Buyer's home, or reason for return. The purchase price does not create equity or resale value in the cat. This policy ensures that every decision about the cat's future is based on the cat's welfare, stability, and lifelong care rather than the possibility of financial recovery or profit.

15  Change of contact information. The Buyer will make reasonable efforts to keep their telephone number, email address, and physical address current with the Seller.

General Contract Terms

16  Entire agreement. This document contains the entire agreement concerning this kitten and replaces prior oral or written discussions on the same subject. Any change must be in writing and signed by both parties.

17  No waiver. A delay or failure by either party to enforce a term does not waive that term or any later breach.

18  Severability. If a court finds any provision unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

19  Governing law. This agreement is governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta. The parties submit to the courts of Alberta for disputes concerning this agreement, subject to any law that requires otherwise.

20  Electronic signatures and copies. Electronic signatures and signed counterparts are binding to the same extent as an original signature. Each party may retain a copy of the completed agreement.

Acknowledgements

By signing, the Buyer confirms that:

• the Buyer has read and understands every page of this agreement;

• the kitten is being purchased as a companion with absolutely no breeding rights;

• the Buyer accepts responsibility for spaying or neutering the kitten by 12 months of age and sending proof;

• if the Buyer can no longer keep the cat, the cat must be returned directly to the Seller, the Seller alone will choose any future home, and no refund or compensation will be provided;

• the Buyer has had the opportunity to ask questions before signing; and

• all information the Buyer has provided to the Seller is true and complete.
